Esos created payment enabled rings in the USA. It was started by three people: Joseph Prencipe, Rex Scates and Shelly Silverstein. Mr. Scates and Mr. Prencipe, an attorney, had a pre-existing relationship as Prencipe had represented Scates on several matters, including intellectual property, such as patents. In early 2016, Mr. Scates paid Prencipe for rights to 50% of a patent assignment for contactless payment rings. Mr. Scates also paid other fees to keep the patent assignment properly registered.

Unbeknownst to Mr. Scates, Mr. Prencipe sold his rights to the patent in October 2016. Mr. Scates never provided authority or approval to sell his patent rights. And, Mr. Scates did not discover Prencipe had sold his rights until years later, during subsequent litigation discovery. In fact, less than 1 month after secretly selling the Scates patent rights, Mr. Prencipe created all of the documentation that was required to start Esos with Mr. Scates and assigning the same patent rights over to a jointly owned holding company. Still, Mr. Scates was unaware that Prencipe had sold his rights.

By December of 2016, Mr. Prencipe had stopped communicating with his Esos partners, Mr. Scates and Shelly Silverstein. So, they removed Mr. Prencipe from the Esos board. At this point, Mr. Prencipe vowed to ruin Esos and Ms. Silverstein if he was sued. They sued him anyway upon learning he . They had some early wins in the litigation. Then, Ms. Silverstein's electronics were hacked and someone attempted to physically harm her. With Mr. Scates help, video evidence was obtained and Ms. Silverstein was granted a 5 years restraining order against Mr. Prencipe. Later, Ms. Silverstein requested the LAPD review the evidence and send it to the District Attorney's office for review. They did not do so when she originally filed the report. Upon asking again in 2024, the statute of limitations had passed.

Unfortunately, Mr. Prencipe has since admitted under oath in other Federal testimony that he was under the influence of drugs during and after the period of time he was involved with Esos, time that also overlapped with his testimony in the Esos civil litigation. However, according the Los Angeles District Attorneys office, they have not prosecuted perjury since the OJ Simpson trial.

Years went by as the parties litigated furiously between 2017 -2022 for rights to the patent family for contactless rings. Through the evidence process, Esos learned that Prencipe had deleted thousands of pages of key evidence, leaving the company in a very difficult position. The system itself was no better. In one case, an elderly Superior Court Judge took so long to make decisions that an evidence master was retained to help speed things up. However, when it came time for a trial, Esos was denied a jury trial by the judge. The judge was a prior colleague of opposing counsel in the Esos case; she required a bench trial where she was the sole arbiter. Esos lost.

Subsequent to the trial, Mr. Scates sued Mr. Prencipe in Santa Cruz County regarding the patent. Scates won. The judge ruled that not only had Prencipe defrauded him, he violated multiple codes of legal conduct. Mr. Prencipe appealed the case. Because it was small claims court, Mr. Scates was not allowed to have counsel, yet Mr. Prencipe is an attorney. With a brain tumor the size of a golf ball, Mr. Scates appeared and tried to argue his case, but he lost; however, he only lost on the statute of limitations, not the substance. Mr. Prencipe was still an unethical thieving attorney, Rex just couldn't get his money back. Mr. Scates filed a complaint with the State Bar of California. The State Bar investigated Prencipe, including the scathing ruling by the Santa Cruz judge. His discipline by the State Bar remains confidential.

Mr. Scates and Ms. Silverstein made the decision to move on and seek to use Mr. Scates designs and technology outside the USA with another entity. It was at this point that Esos began an SEC investigation after losing the patent case and more will be posted here with attorney approval as that situation unfolds.
